Allergan Breast Implants

Allergan Breast Implants Recalled Due to Breast Cancer Concerns

Thousands of women in the U.S. have filed breast implant lawsuits due to failed breast implants. In the case of Allergan implants, studies have shown a connection between breast implants and cancer of the lymphatic system. If you have Allergan breast implants that have been recalled, you may be entitled to significant financial compensation, especially if you have developed cancer.

Allergan did not take safety concerns serious enough. They put profits first over the safety of women.

Allergan has known for years that there were serious safety concerns with their breast implants. They knew of the risks with textured implants and according to recent lawsuits filed against Allergan, they knew of this long before they recalled certain products in 2019. Don’t be silenced. You have rights. We have your back.

From 2014 to 2019, over a quarter of a million women received textured breast implants made by Allergan Pharmaceuticals. These implants have now been recalled because they have been shown to cause a certain form of breast cancer. Already, hundreds of women have been sickened by their implants. Others have needed surgeries to remove their Allergan implants because of concerns about their health. If you have Allergan Biocell implants and have been injured or have needed additional surgeries, you may be entitled to financial compensation. We can connect you with an attorney who can discuss your case, explain your legal options and file a lawsuit on your behalf.

In 2019, the FDA requested that Allergan recall its textured breast implants sold under the Natrelle brand. The agency had been aware of the connection between these implants and a type of breast cancer called anaplastic large cell lymphoma (ALCL) for almost a decade. By 2019, the number of reports of this type of cancer reached the point where the FDA decided that it had to do something.

In all, eight different breast implants and tissue expanders were on the recall list. This was on top of a prior 2015 recall that affected other Natrelle implants. Women who received these implants were not told to have their existing implants removed, although many have opted for additional surgeries due to the risks.

The Lawsuits Have Alleged that Allergan Has Been Selling Products that it Knew Were Dangerous for Decades

As long as the FDA knew about this problem, there are allegations that Allergan knew about it even longer. One lawsuit has alleged that Allergan had knowledge that textured breast implants could cause ALCL all the way back in the 1990s. This means that they sold a product that had full knowledge was dangerous for over two decades, while reports of illnesses mounted.

There are even allegations that Allergan tried to take advantage of a loophole in FDA rules to keep the public from knowing about the dangers of these implants. Until recently, some companies were allowed to self-report non-major problems with its medical devices in a quarterly spreadsheet. However, serious problems were to be reported through the FDA’s MAUDE system that the public is allowed to see. Allergan reported these cases of ALCL in the non-public system, keeping them from the public. There are even allegations that Allergan used fictitious company names for its reports to hide the true dangers of these implants. They did not want you to see the real story, while they continued to tell you that their product was safe.

The lawsuits paint a picture of a company that was determined to keep selling a money-making product that it knew for years was dangerous. It was allegedly so intent on making every penny that it could that it skirted the laws for reporting dangers about which the public needed to know.

ALCL Is Very Rare, But it Is Far More Common with Allergan Textured Breast Implants

ALCL is a very rare form of cancer. On its own, it occurs in roughly one in every 300,000 people. The rate is far higher for people with Allergan textured breast implants. Studies have placed this risk at somewhere between 1:3,817 and 1:30,000. Even the lowest number means that implant recipients have ten times the normal risk of ALCL. The reality can be far worse.

ALCL is a potentially aggressive form of cancer. While it is considered to be treatable, certain forms of it have a far lower survival rate. There are reports of at least 33 cancer deaths tied to Allergan’s implants, and the true numbers may be far higher. ALCL is not only life-threatening, but it also imposes significant financial costs in the form of:

  • Medical bills
  • Lost wages
  • Pain and suffering
  • Emotional distress

If your lawsuit is successful, you can be paid back for all of the harm that you have suffered. If your loved one has died from ALCL, you can file a wrongful death lawsuit against Allergan.

You Can Hold Allergan Responsible for What it Has Done

True to form, Allergan has tried to escape legal responsibility for the harm caused by its product by trying to have these cases dismissed. However, a federal judge has ruled that these cases may move forward, meaning that you can have your day in court. If you have suffered any sort of damages from your Allergan implants, you can file a lawsuit. The major allegation in these lawsuits is that Allergan failed to warn the public of the dangers of its product when it knew about them for decades.

Not only has Allergan tried to keep women from suing, but they have also engaged in questionable tactics to strip women of their legal rights. They offered a paltry amount of money to help women with some of their large bills related to these dangerous implants while trying to sneak in a release clause that requires that women waive their right to sue. The company was offering women who had cancer the insulting amount of $7,500 towards their cancer surgery when their legal liability could be hundreds of times more. Alllergan’s lawyers have even pressured possible plaintiffs to sign this agreement. Do not give up your legal rights for far less than they are worth!

You Can Even File a Lawsuit if You Have Not Been Diagnosed with Cancer

These lawsuits are not just limited to those who were diagnosed with cancer. You can also file a lawsuit if you needed an additional surgery to remove the implants because these come at both a monetary and physical cost. Allergan has refused to pay for surgical procedures to remove the implants, leaving women to foot this large bill on their own.

These are serious lawsuits that Allergan is facing. Some plaintiffs have even accused the company of fraud because of how it allegedly manipulated the FDA’s reporting system. Right now, there are almost 900 pending lawsuits in federal court in New Jersey. If you have been injured by these textured breast implants, you do not have to let Allergan get away with their conduct.
